BY PROCEEDING TO DOWNLOAD, INSTALL OR USE THE SOFTWARE PRODUCT IN WHICH THIS AGREEMENT IS ELECTRONICALLY EMBEDDED, OR BY CLICKING “I ACCEPT,” YOU (“CUSTOMER”) HEREBY ACKNOWLEDGE AND AGREE TO BE BOUND BY THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THE PRIVACY POLICY, THEN DO NOT INSTALL OR USE THE SOFTWARE AND DELETE THE SOFTWARE FROM YOUR COMPUTER SYSTEM. IF YOU ARE AGREEING TO THIS PRIVACY POLICY ON BEHALF OF OR FOR THE BENEFIT OF YOUR EMPLOYER OR A THIRD PARTY, THEN YOU REPRESENT AND WARRANT THAT YOU HAVE THE NECESSARY AUTHORITY TO AGREE ON YOUR EMPLOYER’S OR THAT THRID PARTY’S BEHALF.

 

WHAT THIS PRIVACY POLICY COVERS:

This Privacy Policy governs Customers’, and their Authorized User’s, access and use of Confirm4Me, an Email Phishing & Business Email Compromise Prevention Solution, including any Documentation (the “Product”). The Product is the property of Confirm4Me, Inc. (hereinafter “C4M,” “we,” “us,” or “our”) and is subject to the following Privacy Policy. The terms “you” and “your” refer to our Customers and their End Users who access and use the Product.

Your privacy is very important to us. We value your privacy and are committed to protecting your personal information. Please read this Privacy Policy carefully. By using our Product, you signify your consent to our collection and use of your personal information in accordance with this Privacy Policy. Please also read any Software License Agreement, End User’s License Agreement and/or Terms of Use which set out the terms governing the use of our Product.

In connection with using our Product, we may collect information from you which can be used to identify you, such as your name, address, employer, title, business email address, phone number, IP address, photo, username and password (“Personal Data”). This Privacy Policy explains what Personal Data about you we collect from you and others, and how we use it. As you use our Product, we want you to be clear how we are using your information and the ways in which you can protect your Personal Data.

By using our Product, you explicitly consent to the use of Personal Data for the purposes described in this Privacy Policy. If at any time you object to any of these uses of Personal Data, you should stop using our Product and notify us that permission for any use of your Personal Data is withdrawn. If you opt-out of the use of your Personal Data, you will not be able to use our Product.

 

DEFINITIONS:

Affiliate(s)” means an entity that directly or indirectly through one or more entities, controls, is controlled by, or is under common control with, the specified entity.

“Customer” means the licensee of this Product, and if licensee is an organization, includes its administrators and end users.

End User” means any of Customer’s employees who are authorized by Customer to access the Product.

“Product” means that certain software and services related to Licensor’s Two Factor Identity Confirmation solution, also known as System and Apparatus For Providing Authenticable Electronic Communication (patent pending) A/K/A Confirm4Me, including any Documentation.

 

WHY WE COLLECT AND USE PERSONAL DATA:

We use your Personal Data with your consent and in furtherance of our legitimate interests, including providing you with the Product you have requested or authorized. The Personal Data we collect from you and others you have authorized allows you to use our Product. We collect and use your Personal Data to provide you the best experience with our Product.

 

WHAT PERSONAL DATA WE COLLECT AND HOW WE COLLECT IT:

We may collect Personal Data in the following ways:

    1. Information You Provide. Our Product requires you provide your Personal Data to register to use our Product. When you register for our Product, we may ask for personal information, such as your name, company/business, business address, business email address, business telephone number and other personal information necessary for you to use our Product. You may also provide us Personal Data when you use our Product or report a problem with our Product.
    2. Information Your Employer Provides. In addition to Personal Data you may provide, C4M may also collect Personal Data provided by your employer, which is our Customer. Your employer may provide us information about you, with your consent, so that you may use our Product. If your employer provides any of your Personal Data to us, your employer is responsible for providing any notices and/or obtaining any consents necessary from you for us to access and use the Personal Data. We do not control information collection or use practices of your employer. Once your Personal Data is provided to us by your employer, you may access and control your Personal Data pursuant to the provisions of this Privacy Policy.
    3. Information We Get from Your Use of Our Product. We may collect information about the Product that you use and how you use it. This information may include:
    • Device Information – We may collect device-specific information, such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number.
    • Log Information – When you use our Product or view content provided by C4M, we may automatically collect and store certain information in server logs. This may include details of how you used our service, such as your event attendance; internet protocol addresses (IP addresses); system activity, browser type, the date and time of your request and referring URL; and cookies that may uniquely identify your browser.
    • Access Token – The Product will require you to have a unique access token and credentials. This information may be kept by C4M when you use our Product.
    • Cookies and Anonymous Identifiers – We use various technologies to collect and store information when you use our application or our Product. This may include sending one or more cookies or anonymous identifiers to your device. We use information collected from cookies and other technologies, like pixel tags, to improve your user experience and the overall quality of our Product. C4M does not use these cookies contained within our Product for targeted advertising. You may set your browser to block all cookies but doing so may affect the function of our Product.

 

HOW WE USE PERSONAL DATA WE COLLECT:

We use your Personal Data to provide you with our Product. We do not share your Personal Data with any third parties for marketing purposes. C4M will never sell your Personal Data. We may use, share and disclose information about you, including Personal Data, in the following ways:

      1. To Communicate with You and Provide You with Our Product. We may use your Personal Data to provide our Product to you, to communicate with you about your use of our Product, and for other customer service-related purposes.
      1. To Improve Our Product. We also use your Personal Data to improve and personalize your experience, and to develop new products.
      1. With Our Service Providers. We may share your Personal Data with our Affiliates, vendors, consultants and other service providers, who may help us provide and support our Product. These service providers agree to only use such information for the purposes for which they have been engaged by C4M, and in a manner consistent with this Privacy Policy.
      1. With Your Employer. We may share some Personal Data with your employer as necessary for them to administer certain Product features and enable your use of our Product.
      1. Disclosures for Law Enforcement and Other Purposes. We will share your Personal Data when we have a good faith belief that doing so in necessary to: (i) meet any applicable law, regulation, legal process or enforceable governmental request, including to meet any national security or law enforcement requirements; (ii) enforce applicable Terms of Use and/or provisions in license agreements, including investigation of potential violations; (iii) detect, prevent, or otherwise address fraud, security or technical issues; (iv) protect against harm to the rights, property or safety of C4M, our users, or the public as required or permitted by law; and (v) in the event that we become involved in a merger, acquisition, or any form of sale of some or all of our assets, we will ensure that the acquiring organization agrees to protect Personal Data in accordance with the commitments we have made in this Privacy Policy.
      1. Non-Personally Identifiable Information. We may share aggregated, non-personally identifiable information publicly and with our clients. For example, we may share such non-personally identifiable information to show trends about the general use of our Product.

OTHER IMPORTANT PRIVACY INFORMATION:

      1. Information Security – C4M is committed to protecting the security of your Personal Data. We use a variety of security techniques to protect your Personal Data from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold, including the following protections: (i) we encrypt many of our Product features (communication is transmitted using the HTTPS protocol, using industry standard encryption algorithms); (ii) we review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems; and (iii) we restrict access to your Personal Data to C4M’s employees, contractors and agents who need to know that information to process it, and who are subject to this Privacy Policy.
      1. Where We Store and Process Personal Data. C4M stores and processes Personal Data on our servers in various locations. We may store and process your Personal Data on a server located outside the country where you live. Regardless of where the Personal Data is stored, we take steps to ensure that the data is processed according to the provisions of this Privacy Policy and the requirements of applicable law. The privacy and data protection laws and rules regarding when government authorities may access data may vary from those in the country in which you live.
      1. Changes to Privacy Policy. We regularly review our compliance with our Privacy Policy, which may change from time to time. We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide email notification of Privacy Policy changes.
      1. Third-Party Links. Our Product may link to other sites that we do not control. In such cases, the site you linked from may collect your information. These third-party sites are governed by their own privacy policies. Be sure to review these privacy policies when visiting such sites to see how they collect and use this information. We are not responsible for the content of privacy practices of such third-party sites.
      1. ‘Do Not Track’ Notifications. Some browsers allow you to automatically notify websites you visit not to track you using a “Do Not Track” signal. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online products, we currently do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser.
      1. Children Under 13. C4M’s Product is intended for general audiences and is not directed to children under the age of 13.  Children under the age of 13 are not permitted to use our Product. We do not knowingly collect Personal Data from children under the age of 13, or other individuals who are not legally able to use our Product.  If we obtain actual knowledge that we have collected Personal Data from a child under the age of 13, we will promptly delete it, unless we are legally obligated to retain such data.

The following supplements our Privacy Policy above and applies if you are a California resident:

CCPA: The California Consumer Privacy Act of 2018 (CCPA) provides California residents with specific rights regarding their personal information and exempts business-to-business communications from certain provisions of the CCPA. Your use of the Product and the Personal Data collected in connection with such use constitute a business-to-business communication.

Our Privacy Policy above describes the personal information/data we collect, how we use that information and with whom we share that information. We do not sell personal information. We will not discriminate against you for exercising any of your CCPA rights.

Shine the Light Law: California’s “Shine The Light” law allows California residents to request certain information about our disclosure of personal information with third parties for direct marketing purposes. As stated in our Privacy Policy above, we do not share any Personal Data with third parties for direct marketing purposes.
